Another Reason to Avoid Probate in NC

The North Carolina Legislature is considering cuts of up to 24% in salaries of judicial system employees, which include Clerks of Court and their staff.  Obviously, this may lead to staff shortages and/or staff turnover, both of which may cause delays in processing probate documents, particularly Annual and Final Account.  As it is now, at times I have had wait several months for the filings to be approved.

can a person whose spouse passed away now 8yrs ago simply refuse to go to probate court with the spouses will? can they simply carry on renewing plates on car etc that were in the deceased person's name without retitling to show they have died (ie all to avoid costs of probate court) spouse is /was sole heir.

RESPONSE: Probating a Will is only required if there is probate property - I cannot answer your question without knowing more about what property the decedent owned. It is not proper to continue renewing plates on a vehicle owned by a decedent.
