That article does not even address the bigger problem. What if we do see an unlimited exemption in 2010, although very unlikely. Depending on the wording of your documents you could leave everything to the surviving spouse and not get it into a lower generation when you have the chance to do it tax free. Drafters may have assumed we would never get to 2010 and not planned accordingly.
