NC Trust Law Allows Decanting

Effective October 1, 2009, Trustees of North Carolina trusts can, subject to certain requirements, appoint the trust property to another trust for the same beneficiary.  This "decanting" power can be useful in helping to protect trust funds.  The law applies to trusts created before and after the effective date.

How much should I expect to pay to set up a living trust for my wife and I in North Carolina?

RESPONSE: It depends on a number of factors, such as the size of your estate and the type of planning you desire. Beware of "one size fits all" trusts. I encourage you to consult with a couple of attorneys who specialize in estate planning.

If you have a revocable trust and it is written on after it is executed will it still be valid?

RESPONSE: It depends on the circumstances, but I do not recommend it.
