NC Probate Filing Fees Increase

Effective July 1, 2010, the fee for opening a probate proceeding in North Carolina increased by $1.00 to $89.00.  While one dollar is not much of an increase, it is representative of the trend over the last few years to raise court costs.  It will only get worse, making living trusts to avoid probate that much more attractive.

what is the filing fee for continuing a probate proceeding? Did it also increase. thanks Ellen

I live in Ga but have a 2nd home in NC.Assumed vale is $1M.
Do I need to establish a trust in Ga to avoid probate in NC?
The $89 fee is no problem but I don't want my family to be taxed on .04 Cents per $100 which would be $4,000.

RESPONSE: The fee on the value of property generally does not apply to real estate, but there are other reasons to use a trust to avoid probate. I recommend consulting with an NC estate planning attorney to determine the best course of action for you.
